LYNDON — Lyndon is a “10 acre town.” That means commercial development on properties over 10 acres must obtain Act 250 approval. However, there is a loophole. Developments that serve a municipal, county, or state purpose are measured by area impacted, not total land area. The “public good” exception was successfully applied last month to a proposed Northeast Kingdom Human Services residential facility on Cornerstone Lane. After more than a year of legal proceedings, the Vermont Natural Resources Board agreed to recognize Cornerstone Lane as a “state purpose” development and withdraw Act 250 requirements, because the project will only impact a small portion of the 12-acre property.
