Whitefield Planning Board Conditionally Approves Mirror Lake Subdivision
WHITEFIELD — The Planning Board conditionally approved a two-lot subdivision Aug. 4 despite objections from residents of Mirror Lake Estates and an attempt to halt the hearing through a court order.
The board voted to accept as complete an application from John Peter Berquist to subdivide a 3.05-acre lot on Mirror Lake Estates Drive into two lots of 1.29 acres and 1.76 acres, according to meeting minutes.
The hearing was complicated by an emergency temporary restraining order that residents said had been obtained to prevent the subdivision hearing from proceeding. Ryan Presby, a Mirror Lake Estates resident and vice president of the homeowners association, presented a second court order during the hearing that he said a Superior Court judge had signed.
The board declined to halt the hearing, saying town counsel advised it that the orders had not been properly served on the town. The minutes also state that the second order was presented during the hearing, leaving the board without an opportunity to consult its attorney.
